By downloading, installing, accessing, or using What They See (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

We are not responsible for any injury, damage, or harm resulting from distracted use of the App or failure to maintain awareness of your surroundings.
All purchases are processed by Apple through the App Store. By making a purchase, you also agree to Apple's terms and conditions for the App Store.
Purchases are tied to your Apple ID and can be restored on other devices signed into the same Apple ID at no additional cost.
Refund requests are handled by Apple according to their App Store refund policy. We do not process refunds directly. To request a refund, contact Apple Support or use the "Report a Problem" feature in your purchase history.
By making a purchase, you consent to your consumption data being shared with Apple through our payment processor (RevenueCat) for purposes including subscription management, customer support, and refund processing.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes.

IN NO EVENT SHALL SPECIAL GLASSES LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID FOR THE APP OR ITS FEATURES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by applicable law.
You agree to indemnify, defend, and hold harmless Special Glasses LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

Before filing any formal dispute, you agree to first contact us at spatial@specialglasses.net and attempt to resolve the dispute informally for at least 30 days.
Any disputes not resolved informally shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS PART OF ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Special Glasses LLC regarding the App and supersede all prior agreements.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
We will not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet/telecommunications failures.
